SCOTUS Upholds Tennessee’s Ban on Trans Surgeries for Minors

In a 6-3 ruling, the Supreme Court ruled in favor of Tennessee’s law banning gender transition surgeries for minors (as if it’s actually possible to transition one's gender). Justices Sonia Sotomayor, Ketanji Brown Jackson, and Elena Kagan dissented, with even Amy Coney Barrett voting in favor.

The law targets doctors and healthcare providers in the state who provide such proceeds, and opens them up to fines, lawsuits, and other liability. Sotomayor voiced “sadness in reading” the dissent.

This greenlights other states adopting similar bans.

The petitioners challenging the law nonsensically argued that it violates the Equal Protection Clause of the Fourteenth Amendment, which prohibits discrimination based on any identity markers, such as race, gender, religion, or national origin. In their mind, not letting children mutilate their own bodies is discrimination.

According to Fox:

Writing for the majority, Chief Justice John Roberts ruled that the law question is not subject to heightened scrutiny "because it does not classify on any bases that warrant heightened review. This case carries with it the weight of fierce scientific and policy debates about the safety, efficacy, and propriety of medical treatments in an evolving field," he said. "The voices in these debates raise sincere concerns; the implications for all are profound."

The ruling could also serve as a legal pretext in future cases involving LGBTQ+ protections, including whether sexual orientation qualifies as a "protected class" on par with race or national origin.

"The Equal Protection Clause does not resolve these disagreements. Nor does it afford us license to decide them as we see best," he added. "Our role is not ‘to judge the wisdom, fairness, or logic’ of the law before us … but only to ensure that it does not violate the equal protection guarantee of the Fourteenth Amendment. Having concluded it does not, we leave questions regarding its policy to the people, their elected representatives, and the democratic process."

The tide is finally turning on the trans insanity - now let’s hope more states follow Tennessee’s lead.
